Assistant U.S. Attorney (2004-2013)
As a federal prosecutor, defended and prosecuted on behalf of the United States over 100 lawsuits and investigations, including claims alleging fraud, harassment, discrimination, retaliation, wrongful termination, personal injury, contract, malpractice, civil rights violations, real property disputes, insurance coverage issues, FOIA and APA challenges, as well as constitutional, religious, and privacy challenges. Successfully mediated or negotiated the resolution of over 50 cases, and many investigations. Successfully defended the United States in personal injury trials, and prepared and successfully argued numerous summary judgment motions and motions to dismiss. Successfully argued employment and civil rights cases before the Ninth Circuit. Took and defended over 100 depositions, including depositions of defendants, plaintiffs, expert witnesses, company executives, other employees, and eye witnesses.
Representative Cases:
- Successfully defended numerous federal agencies in cases alleging sexual harassment, retaliation, wrongful termination, and gender, race, religious, disability, and age discrimination.
- Prosecuted health care professionals and their businesses in cases alleging health care fraud and false claims to Medicare and Medicaid, negotiating settlements that resulted in the professionals paying millions of dollars back to the federal government.
- Successfully defended doctors and other federal employees in cases alleging medical malpractice, negligence, and personal injuries in automobile accidents.
- Prosecuted one of the largest pharmaceutical companies in the world for off-label marketing and submitting false claims to Medicare and Medicaid, which resulted in the company paying $184 million dollars to the federal government.
